Incipit:

  • [{i}first part's first chapter:{/i}] Of judgement, cap. 1. Definition of judgement. Judgement is ane examinatioun or disceptatioun of any contraversie, or ane lawfull act that is done in the place quair causses ar decydit. The quhilk consistis in thrie persons, videlicet in ane judge, ane persewer and ane defender. The substance of the same consistis in the same thrie persons. Of the quhilkis, if any be absent, thir is no iudgement.

    Parts of judgement.

    The substantiall and principall pairte of judgement is the sumonds, libell or petitioun, the aith callit 'iuramentum calumniae', litiscontestatioun, the conclusioun, and sentence in writt.

    And albeit the king may discharge sic solemnities as ar statute to be observit in iudgement introducit be the law positive, callit the law of man, sic as litiscontestatioun, the dilationis or dyetts assignit to give in articles or use probatioun, zit may he not discharge ony inducit be the law of nature, as the citatioun of Adam efter his offence, beand in Paradise, when he sould have bein condemnit, he was first callit [Bible:{i}Genesis 3.9{/i}].

    Judgement is finishit, declarit and made null, and als unlawfull, and that sundrie wayis.

This extraordinar way is observit quhen the cryme is notour and manifest, sua that thair necessites(?) na accusatioun, inquisitioun, denunciatioun, nor zit exceptioun, nor na(?) witnes nor probatioun. For thair is na better prufe nor appeires be the manifestnes of the deid. The last maner of notorietie is quen it is sua evident to the sight of men
