Ius proprium Scotiae - Practicks (general digest of law, systematic) (preparatory list of tasks to do)
Author(s):
Ius proprium Scotiae - Practicks (general digest of law, systematic) (preparatory list of tasks to do) .
Instructions to a scribe, to merge three pre-existing works: one digest of Acts of Parliament (probably based on the printed edition of 1566, or on abstracts drawn from there), another digest of judicial precedent (= 'Practicks'), and a third digest of the "Auld Lawis". The scribe was supposed to merge the three separate works into one all-comprehensive digest ({i}this was the origin of the text which became known as 'Balfour's Practicks'{/i}).
The pertinent titles of the three digests are listed, with abbreviations A (= Acts, alphabetical Digest), P (= Practicks, alphabetical Digest, see MS Edinburgh, EUL, Laing III. 388), and M ( = Maiestatem). The latter abbreviation obviously refers to the digest of the "Auld Lawis" in six books as copied further on in the present MS, and also preserved in MS Edinburgh, UL, Laing III.381a. Compare earlier attempts of the kind, still in Latin, which are preserved in Edinburgh, NL Scotland, Adv.MS.25.4.11 and MS London, BL, Addit. 48050, and an attempt to translate that text, in MS Edinburgh, UL, Laing III.423.
This is only a copy. In the original, obviously, each entry must have been written on a separate line, in order to leave space for possible additions at the end of the line. In the present MS, however, the entries follow each other so closely so that nothing could be added or inserted. My transcription of the text therefore re-constitutes separate lines.
