Acta litigationis Scotiae: William Forbes Laird of Monymusk contra James Irving, minister of that parish, 1568-1608 , action for reduction of taks.
The description in the library's inventory gave me the hope that the MS might contain minutes of proceedings in court. The case raised legal problems and was therefore reported by Sir Thomas Hope of Craighall, 1610/2/21 (Edinburgh, NL Scotland, Adv.MS.6.2.11 page 3, copied from Adv.MS.6.2.5). An earlier decision 1609/3/5 was reported in Edinburgh, NL Scotland, Adv.MS.24.2.3 vol. 3 page 810. Yet, the present MS consists mainly of early 17th century copies of documents and copies of register entries, starting with a letter of presentation 1568/7/15 for Alexander Arbuthnot, by the Regent Moray, to one of the church prebends of the cathedral at Aberdeen, and ending with a document dated 1608/10/8. Interspersed are sheets titled 'Informatioun for Monymusk' or 'Memorandum' (no. 14-15, 18, written ca. 1607), but they only deal with facts and evidence for facts, and they do not contain arguments in law
