  • [{i}First entries:{/i}] A. Absents rei publicae causa, accusers and accusatio. Absentes rei publicae causa are priviledged in order of proces, and dureing thair absence in publict employments proces should not be sustained against them: act 32, Par. 6, Q(ueen) M(ary).

    Lex talionis hes no place against accusors in criminall cases, except allennerly in cases of treasone and laesae maiestie, in quhich, if the partie accused be acquitt and found innocent, the accuser is guiltie and lyeable thairof: act 49, Par. 11, J[ames] 6. Bot in other crymes.

    Item that no criminall lettres be direct for summonding of complices, to be given in, in ane bill, be the partie of purchaser thairof.

    Item that both accusers and defenders in criminall causses compeir in sober manner to justice.

    Item that no person accused as guiltie of any cryme be holden pro confesso before conviction, or denyed the libertie and priviledge of advocats in defence of his lyfe, lands and libertie.
