Wee have no other lawe bot the Acts of Parliament, whilk, albeit they be for the most pairt pennd for the policie of the kingdome, yet there are many of them which decides causes, and by these first the Lords of Session judges causes. Were there is no Act of Parliament, then wee judge by ane perpetuall consuetude, whilk wee call 'practique', bot it is not to be followed, tho never so old, if it be against the written lawe.

    Practiques are to be used as the Lords useth wittness insert in contracts or bands, videlicet the testimony is ever beleeved, bot when any doubt arises aither anent the mind of the contracters or anent the clearing of that whilk was done
