[{i}First preserved items:{/i}] This same day in ane actioun of compt and reckneing betwixt the Earle of Linlithgow contra maister Johne Fraser, the Lords susteanid ane obligtioun grantit for repayment of tailziet moneys according to the speces of the money grantid to be resavid be the obligatioun(?) and fand that the partie obleist aucht to repay the same according to the prices as that.

6 Martii 1623. Maister Donald Scherp, persoun of Kilbryd, ratifies to Robert Hamiltoun of Newhouss his tack quhilk the said Robert had ... [{i}Morison 16574 = Durie pag. 55{/i}].

This same day in the abovewrittin actioun mentioned (on) my preseiding page, Stevisoun contra Stevisoun, quhair the Lords fand that the saisine could not be drawn back. It wes replyed for the persewar that the defendar could not qwarrell the title becaus he was his tutor, wha of the law wes haldin to have obteanid the persewar in dew tyme seasit as air.

This same day in ane actioun of Robert Finlisoun contra David Johnston, the Lords fand that any persoun might compryse ... [{i}Morison 8115 = Durie pag. 56{/i}].

7 Martii 1623. Laird Barganie being obleist in his contract of mariage with Josias Stewarts doughter to infeft the bairns of that mariage in his lands ... [{i}Morison 10418 (misprinted year date 1627) = Durie pag. 56, Fol. Dict. vol. 2 pag. 56{/i}].

In this same proces the Lords fand and sustainit the actioun, albeit it wes movid be the father aganist his owin hous, being pupills whom be the law he aucht to defend.

8 Martii 1623. In ane persuit at the Kings advocats instance aganist ane Morisoun in Dumblaine to heir him beine decernid to be punisched as ane usurer.

9 Martii 1623. James Muirheid in Hamiltoun, debtor to umquhill William Muirheid burges of Edinburgh, in ane sowme of mony [{i}Morison 2789 = Durie pag. 58{/i}].

11 Junii 1623. Litiscontestatioun being maid in ane action of improbation, persewit at the Erle of Homs instance and the Kings (Advocate), aganist Cranstoun of Moristoun, ane incident being raisit onlie at the Erle Homes instance for proving of such payments as be the act of litiscontestatioun wes admittit to his probatioun, quhilk incident was not rasid also at the Kings Advocats instance, the Lords notwithstanding thairof sustanid the incident, becaus the advocat concc[!]urrit and declairit that he insistit thairin with the pairtie.
