[{i}First preserved items:{/i}] This same day in ane actioun of compt and reckneing betwixt the Earle of Linlithgow contra maister Johne Fraser, the Lords susteanid ane obligtioun grantit for repayment of tailziet moneys according to the speces of the money grantid to be resavid be the obligatioun(?) and fand that the partie obleist aucht to repay the same according to the prices as that.
6 Martii 1623. Maister Donald Scherp, persoun of Kilbryd, ratifies to Robert Hamiltoun of Newhouss his tack quhilk the said Robert had ... [{i}Morison 16574 = Durie pag. 55{/i}].
This same day in the abovewrittin actioun mentioned (on) my preseiding page, Stevisoun contra Stevisoun, quhair the Lords fand that the saisine could not be drawn back. It wes replyed for the persewar that the defendar could not qwarrell the title becaus he was his tutor, wha of the law wes haldin to have obteanid the persewar in dew tyme seasit as air.

9 Martii 1623. James Muirheid in Hamiltoun, debtor to umquhill William Muirheid burges of Edinburgh, in ane sowme of mony [{i}Morison 2789 = Durie pag. 58{/i}].

Litiscontestatioun being maid in ane action of improbation, persewit at the Erle of Homs instance and the Kings (Advocate), aganist Cranstoun of Moristoun, ane incident being raisit onlie at the Erle Homes instance for proving of such payments as be the act of litiscontestatioun wes admittit to his probatioun, quhilk incident was not rasid also at the Kings Advocats instance, the Lords notwithstanding thairof sustanid the incident, becaus the advocat concc[!]urrit and declairit that he insistit thairin with the pairtie.
