Ane deitt auchtand be ane communitie man [{i}= must{/i}] be socht and recovered agains the communitie, and not particularlie agains any ane of the provest, baillies, counsale or communitie, becaus omnes tenentur in solidum. Nam quod universitas debet, singuli non debent. Thus it wes found and decydit in a caus betuix Mr. George Mewins, ane of the baillies of Sanct Androis and Lewmont, 24 Novembris 1595

Ane appeirand air hes gude actioun and entres to call and persew for exhibitioune of his father or uther his predicessour, to quhome he is appeirand air, thare writts and evidents, and effect exhibitioune, he may adwyse quhidder to enter air or not, and may renunce to be air, rebus integris
  • (3.) Ane precept of 'Clare constat' will preve agains ony man to mak him air to his predicessour, bot will not preve with him to verifie him self to be air in ony persute persewit at his awin instance agains utheris.

    4. Horning will seclude any persoune et ab agendo et defendendo in quhatsumevir caus, bot in ane criminall.

    5. Inferiour judges as scherefis, stewartis, provost and ballies of regalitie will be judges competent to the improbatioune of any wryte produced befoir thame selves be the direct maner, bot thai ar not judges to the indirect maner, onlie the Lords of Sessioune as supreme judges.

In ane caus persewit be [{i}blank space{/i}] agains the Erle of Erroll, quhairintill thair wer witnesses producet agains the Erle, quhilkis witnesses being persewit ane certane space of befoir, befoir the instance of slauchter of ane woman callit Andersoun be ane man that wes freinde to the woman, with the quhilk man the Erle had assyted at the bar, and thairfoir the Erlis procuratour alledgit that thai aucht not be admittit witnesses, becaus the Erle of Erroll, agains quhome thai wer produced, had assyted with the man quha had persewit thame on of thair lyves. The Clerk Register Schir John Skene being than ordinar in the Utter Hous ... adwysit presentlie with the Lords quhidder the witnesses sould be ressavit or not. Thairefter returing, the Lords be interloquitour repelllit the witnesses. Ultima (die) Februarii 1597.

    33. Contraventioune and spoilzie can not be baith obtenit in ane mater and forme and cause, bot eftir decreit of spoilzie is obtenit, the pairtie obtenar may intent contraventioun, gif he pleis, and renunce the benefeite of the decreit of spoilzie and use the samin onlie for preving of the contraventioune.
