Decisiones curiae supremae Scotiae - Practicks 1592-1624: (1592/12/27 - 1593/12/24) .

The text starts right after the end of the series of practicks in MS Signet 34 fol. 128r-151r. I have not yet collated the present text to the original of Haddington's collection in Edinburgh, NL Scotland, Adv.MS.24.2.1

Author(s):

  • Thomas Hamilton later 1st Earl of Haddington

No. of pages: Pag. 635-682

Incipit:

  • [{i}First two items, starting 1592/12/27:{/i}] Anent the confirmatione of few landis, perteining of auld to the kirk. Maister Johne Arthour, commissar, haveing obteined infeftment of our soverane Lord efter his perfytt aige of certane few landis in Galove and Dirltoun, he warnit ane Olipher, possessour of some aikeris of the landis to remove.

    [{i}1592/12/29:{/i}] Edvard Mauchane and Thomas Mauchane, his sone, persewit Agnes Mauchane and George Carkettle, hir sone,.

    .

    [{i}A spot check on page 652 showed correspondence to three practicks of 1592/1/24 and 27 in MS Signet Library 34, fol. 150v-151r. I therefore assume that the entire series of practicks in MS Signet 34, fol. 128r-151r, corresponds to the present MS. Furthermore, pages 656-664, 1593/6-11, might correspond to the subsequent series of practicks in MS Signet 34, there on fol. 153r-155r. The assumptions cannot be verified because the Signet MSS have meanwhile disappeared.{/i}.

    (Pag. 682) [{i}last but one item:{/i}] Gif the persewar of ejectione and spuilzie swear that his title was intromettit withe, the tyme of the committing of the spuilzie, his process will not stay wpone the non-productione thairof, prowyding he prove his title cum processu. The Laird of Mondurk persewit the Laird of Gairleis for ejectioun of him furthe of the castell ... sould preive his title cum processu.

    (Pag. 682) [{i}last item, 1593/12/14:{/i}] Ane supplicatioun being gevin in be [{i}gap{/i}], declarand that he could not apprehend his superiour personallie to chairge him to ressave him and enter him to his landis, it was concludit be the Lordis that it was not necessair that personall chairgis sould be gevine in sic caices, bott it was sufficient at thair duelling place. [{i}The last third of the page is left blank.{/i}].

    [{i}The text in the present MS breaks off with an item directly before the start of practicks in Adv.MS.25.3.6 = 1593/12/24. The handwriting in the latter latter MS is different, however - thus not penned by the same scribe as the present MS. Yet, also MS Signet 34, fol. 156r-163v, breaks off at the same place.{/i}].

    Pag. 683-690 blank. On pag. 690 a motto in handwriting saec. XVIII: 'For ever inter nos omnes(?)'.

    Pag. 691-692 are not existent
