  • In all actiounes and pleyes ar necessar: judex, actor et reus - ane judge, ane persewer and defendar.

    The judge hes sundrie and uther jurisdictiounes, for sume actiounes ar criminall, which concernes lyf and landis or any ane of them, or yet tutches sick crymes as may inferre the confiscatioun of the gudes perteining to the defendar - which criminall actiounes sould be decydit and decernit befoir the Justice Generall or his deputie or ony judges in criminall causses being in questioun of ane assyse of certane reall good men that best knowes the truth and veritie.

    Some actiounes ar ecclesiesticall and perteines to the jurisdictioun of the kirk, which is called 'curia christianitatis', sic as of testamentis, legacie, mariage and devorcement, and civell actiounes of dewties and all uther which ar effected with ane othe, or with ane promeis which is proven with ane aith. Utherwayes civell actiounes quhilk hes not fidei vel juramenti interpositionem, as civell pro[p]haine, and therfoir perteines not to the eclesiasticall jurisdictioun in this realme. The jurisdictioun perteines perpetuallie to the Commissars of Edinburgh and uther who ar substitutes, surrogat in that place and power of the Offitiall wha in the tyme of papistrie had power as substitutes to the bishope of, etc.

    Last, sum actiounes ar civell, concerneing landis, dewties and pecuniall paines, whilk propperlie perteines to the jurisdictioun of the Lordis of Sessioun as suppreme and competent judge, be the executioun and perviledge grantit to thame.
