Ordo iudiciorum Scotiae - Treatise 'Judgment is ane examinatioun' ("Thesaur of practique") .

This is obviously the same work as in Edinburgh, NL Scotland, Adv.MS.24.1.8 and 11, see there. The treatise quotes Digesta, Codex Justinianus, Authenticorum collatio, Decretales Gregorii IX papae ('Liber Extra'), but most propositions of law do not refer to any text of authority. I deem that the scribe, or already the person who translated this work from the Latin, left out quotations. If this is a re-worked translation of a work from the European continent (as I suspect it to be), then it can easily be explained why it has so few quotations: the pertinent quotations could simply be retrieved from the printed edition of the original text in Latin. It was thus not worth while transcribing them in the translation

  • First pairt of the Thesaure of practique. 1. Jugement [{i}= chapter 1.1{/i}]. Jugement is ane examinatioun or disceptatioun of onie contraversie or ane lawfull act that is done in the place quhair causses ar decydit. The quhilk consistis in thre personis, to wit in ane juge and persewer and ane defender. The substance of the same consistis in the same thre personis. Of the quhilk, gif onie be absent, thair is na jugement. The substantiall and principall pairtis of jugement is the summonds, the libell or petitioun, the aithe callit juramentum calumniae, litiscontestatioun, the concensioun [{i}= garbled, 'conclusion' is meant{/i}] and the sentence in writt.

    And albeit the King micht dischairge sic solemnities as ar statute to be observit in jugement, introducit be the law positive callit the law of man, sic as litiscontestatioun, the dilatiounis of dyettis assignit to giff in articles of(?) probatioun, zit he mey not dischairge onie inducit be the law of nature, as the citatioun of Adame efter his offence: beand in paradise, quhen he suld haif bene condamnit, he was first callit [Bible, Genesis 3.9].

    (Fol. 354v) Jugement callit contradictioun is in the quhilk the ane requyris and the uther denyis. And in sic jugement they mey abide with the opinioun of the grittest pairt, except in sum causses as ar numerat in glossa in cap. Pasto. [X.1.31.11 glossa ordinaria].

    (Fol. 354v) Concerning jugement ze sall wit four rewllis: [{i}first rule ={/i}] that the instance of iugement be prorogat to ane terme, albeit, the terme be past, zet the causs sall not perrische, be ressoun that the jurisdictioun is perpetuall, and siclik the interdictis: l. 2, C. de diversis rescriptis [C.1.23.2]. And this reull is aganis the tenour of the law: l. Properandum, declarand that the instance of civile causs contenewis bot thre zeiris at the maist, ut (invenitur?) in dicta lege, C. de iudiciis [C.3.1.13].

    In jugement suld be na exceptioun of personis: ca. In judici., de regulis iuris, libro 6 [6. 5.13.12].
