Formularium - Scottish Styles (dated 1543-1594).

A collection of texts which the 1st Earl of Haddington had found interesting. Most of them probably interested him as styles.

(Fol. 323r) The argument maid super lege prima, D. de aqua quotidiana et aestiva [D.43.20], et super lege prima, D. de rivis [D.43.21], is altogidder impertinent in this mater, for the subiect of that titill De aqua quotidiana et aestiva is in him quha drawis water of fundum alienum to his awin ground, and the titill De rivis is upon the reparatioun of the watergang be the quhilk the water passis - and hes nathing to do in this caice quhilk is presentlie in handis. Bot the decisioun thairof mon [{i}= must{/i}] be gadderit ex titulo De aqua et aqua pluvia arcenda [D.39.3], and this consideratioun thairof. And thairfoir thais rationis ar maist inpertinentlie allegit to this pourpois ... And the said Lordis ground is na wayis obleist to ressave the water drawin be craft furth of the heall ground.

Item as to the prattik allegit betuix Johne Elphinstoun and the Laird of Dundas [{i}= Morison 11075, drawn from Colville's Practicks{/i}] it is answerit thairto: gevand the said prattik wer of weritie, the samin can indicat(?) nathing in this cais, seing that prattik was upon commoun pasturing ... and servitude may be acquyrit be ane zeiris possessioun allanerlie, as is decydit in lege prima, D. de aqua quotidiana et aestiva [D.39.3.1].

We, maister Johne Lindsay, persoun of Monimure [={i}Lord Menmuir{/i}], and maister Johne Grahame of Halzardis, twa of the senatouris of oure soverane Lordis College of Justice, juges arbitratouris and amicabill compositouris ... This blank within subscryvit to be fillit in betuix Alexander commendatar of Pluscarden on the ane pairt and David Dunbar of Cannok on the uther pairt.

(Fol. 337r) Informationes for Jonet Leischman, the relict of wmquhill Thomas Murray, burges of Strivelling, and tutrix dative to John Murray hir sone, in the mater persewit be Walter Reische ... And that the prince may at ony tyme efter the deceis of the father gif tutoris dativis, not abyding zeir and day efter the fatheris deceis, it is manifestlie provin be the commoun law, quia consanguinei, mater et avia tenentur statim a morte patris tutores petere. Et precedente eorum petitione, imo si petitio non precedat, tenetur judex tutores dare: ut probatur toto fere titulo C. qui tutores dare possunt [C.5.34], et toto fere titulo C. de tutoribus et curatoribus datis ab his, etc. [D.26.5] ... [C.5.31.8-9], non ambigitur tutorem testamentarium constitui a testatore ...'.
