Ius proprium Scotiae - Practicks (general digest of law, alphabetical) 'Abbas' - 'Universities' .

Many entries completely in Latin and other entries completely in Scots. This suggests that the work was zipped together from works of other authors. At least one of them wrote in Latin, and at least one other wrote in Scots. The scribe knew Latin, but he garbled references to literature. The repertory quotes many statutes, Craig's 'Jus feudale' (long excerpts in Latin), and at times directly the Corpus iuris. He refers to decisions mainly from Durie's Practicks, but he also used other collections.

The latest year date which I found is 1663 (e.g. pag. 8). The earliest decision which caught my eye dates from 1546 (also on pag. 8): 'No action can be advocat from ane inferiour judge after litiscontestation in the cause. And the cause being once advocat by ane act, it can never thairafter be remitted. H. 28 Juli 1546.'

    Absentes rei publicae causa are priviledged in ordour of proces, and dureing their absence in publick imployment proces should not be sustained against them: Act 32, P. 6, M(aria).

    Actes of parliament should be proclaimed at the mercat cross of Edinburgh, and the liedges are not oblidged thairto as lawes untill 40 dayes after the publicatione thairof: Ja. 6, P. 7, ca. 128.

    Actes of curatorie. A minor chooseing curators befor the 14 year of his age, the act is null, by way of exception, as wes found in 7 Feb. 1627 [{i}MS Edinburgh UL Laing III.420 has: found wpon the 19 December 1634 Cambell contra Chalmers{/i}].

    Actions. Some actions ar civill and some criminall. And of civill actions some are personall only and some are reall only, and some are mixed, partlie personall and partlie reall. Actions personall proceed upon personall obligations, as quhen a partie is oblidged pacto vel lege ad aliquid dandum ... Action reall is quhen.

    Adherence. Husband or wyfe wilfullie divorceing from one another after privat admonition may be ferst persued before the judge ordinar.

    Adjudication is a legall remedie introduced in favores of creditors ... [{i}p. 5-6, an entire page long{/i}].
