Constitutiones extravagantes

Incipit:

  • Unam sanctam ecclesiam [and then:] catholicam et ipsam apostolicam urgente fide credere cogimur

Explicit:

  • committimus\ patrocinio\

Constitutiones extravagantes diversorum pontificum. Text 197 x 115 mm. Watermark: Briquet 3764, 7693, 5908, 4956, 9097, 9131, 11908. Ink black. Reclamants under column vb. For details, see the Singer article cited below. There precede 17 sheets and a flyleaf (= Fol. I, memb.), its recto is blank. Glued to fol. I verso: title 'Extravagantes modernae' and mention of Armarium number XXXII in the Vatican Archives. Fol. 1r-v: blank.

Fol. 2r-17r: Index of extravagantes in the manuscript, written by two scribes. The change of hands occurs in the middle of fol. 16r. The index lists entries up to fol. 513 (of the medieval numbering). This shows that at the end of the manuscript many sheets have been lost.

Fol. 17v: blank.

Main text of the collection: it primarily consists of papal letters dating from the mid-thirteenth to the mid-fifteenth centuries along with some decrees from the Council of Constance. It is therefore similar, although not identical, to the collections found in Vat. lat. 12570 and 12571. The entries here are arranged under titles through fol. 97v, but this system of organization is abandoned after that folio. Although some of the decrees are attributed to a particular pope, a large number are not so identified or are incorrectly identified.

No. of pages: Fol. 18r-351v

Rubric: De summa trinitate et fide catholica. Rubrica. Bonifacius VIII

Incipit:

  • Unam sanctam ecclesiam catholicam et ipsam apostolicam urgente fide credere cogimur ... (fol. 18v:) declaramus dicimus diffinimus omnino esse de necessitate salutis

Explicit:

  • approbamus confirmamus et presentis scripture patrocinio committimus. Nulli ergo ... Si quis autem ... Datum Rome apud sanctum Petrum anno incarnationis dominice mccccxl. octauo iii. kalendas Iulii pontificatus nostri anno secundo. A second hand has added a note after the text: 'Sic signatum sub plica P. de Legendorff'.

The collection was copied by thirteen scribes. The work of each scribe may be set out as follows:

    (1.) fol. 18r-35v and 65r-82v. (2.) fol. 36r-43v. (3.) fol. 44r-50v. (4.) fol. 51r-58r. (5.) fol. 59r-64v. (6.) fol. 83r-97v. (7.) fol. 99r-145r. (8.) fol. 151r-228r. (9.) fol. 231r-301v. (10.) fol. 302r-319r. (11.) fol. 320r-328r. (12.) fol. 330r-v. (13.) fol. 340r-351v. Some folios have been left blank (except for an occasional doodle or stray note): fol. 58v, 98r-v, 145v-150v, 228v-230v, 319v, 328v-329v, and 331r-339v.

    Also the subsequent parts of the manuscripts were penned by many different scribes: (14.) fol. 352r-353v. (15.) fol. 356r-362v. (16.) fol. 366r-368r. (17.) fol. 368r. (18.) fol. 372r-380v. (19.) fol. 381r-384r. (20.) fol. 392r-398r. (21.) fol. 405-417r - many changes of hand occur in this section. (22.) fol. 420r-423v. (23.) fol. 424r. (25.) fol. 428r-v and 431r-v. (26.) fol. 429r-430v. (27.) fol. 432r-433r.

The changes of hand do not always correspond to the beginning and ending of particular items or of gatherings. The Pragmatic Sanction of King Charles VII of France (fol. 425r-431v), for example, is written in three very different hands.

The entire manuscript is written in single columns with no decoration. Bibliography on the manuscript: Heinrich Singer, Das c. Quia frequenter, ein nie in Geltung gewesenes 'Papstwahldekret' Innozenz' IV. Zugleich ein Beitrag zur Frage der Selbstwahl im Konklave, ZRG KA 6 (1916) 93-96
